State law (F.S. 985.04) allows for the publication of a minor’s name and photograph if that minor is "taken into custody by a law enforcement officer for a violation of law which, if committed by an adult, would be a felony."
The Monticello Police Department (MPD) responded to a complaint of a person being shot in the area of Sage Street on Monday, Aug. 17, at 3:23 p.m. The MPD & Jefferson County Sheriff's Office (JCSO) deputies responded. Once on the scene, an MPD officer saw that a black male had been shot and was bleeding with serious injuries. Jefferson County Fire Rescue (JCFR) responded and transported him to the hospital for treatment. The victim remained at the hospital in stable condition. The Florida Department of Law Enforcement (FDLE) was notified for the use of Investigators and their Crime Scene Van.
The incident location was secured and checked for evidence. Several shell casings were located. An SUV was inspected and determined to have a flat tire and a bullet hole in the left side exterior of the vehicle. After speaking with the vehicle's owner, it was determined that the vehicle's left rear tire was not flat prior to the shooting incident.
The scene remained secure until the arrival of the FDLE Crime Scene Unit. The scene was processed and shell casings were recovered from the roadway of the incident location.
Based on witness accounts and surveillance, law enforcement quickly developed a vehicle description and suspects in the shooting. The JCSO quickly responded to the suspect's residence located on South Mulberry Street and detained them.
Through the investigation it was learned that the driver of the vehicle was Lazarus Mack and his passenger was Martavius Mack. Information gathered identified Martavius Mack as the shooter. Martavius was interviewed post miranda and said he was present and had remorse for the incident. Martavius did not directly confess to his involvement in the shooting. It should be noted that there were numerous people in the direction of the victim's location when Martavius was firing at him. One male subject, on a bicycle, fell to the ground and did not move until after the suspect vehicle left the scene. There was another male subject sitting inside the SUV. That vehicle was struck by gunfire.
Based on the investigation, probable cause was developed to arrest Martavius Mack on the following violations of Florida State Statute:
782.04 (2) Attempted Second Degree Murder by knowingly and intentionally discharging a firearm directly at the victim, while the firearm was aimed at victim's head and torso area.
790.19 Shooting into an Occupied Vehicle by knowingly and intentionally discharging a firearm which expelled a projectile into the SUV which was occupied at the time the projectile entered the vehicle's left rear tire.
784.021 (1a) Aggravated Assault with a Deadly Weapon by knowingly and intentionally discharging a firearm in the direction of a male victim who fell to the ground.
Martavius Mack was placed under arrest by MPD and transported to the Jefferson County Jail without further incident.
Lazarus Mack (20YOA) was arrested due to this involvement in the incident and knowingly & willfully driving Martavious away from the incident location without attempting to contact Law Enforcement Charged with:
777.03 (1C) Accessory After the Fact
Lazarus Mack was placed under arrest by MPD and transported to the Jefferson County Jail without further incident through the efforts and quick response of the MPD, JCSO, FDLE, JCFR and the concerned citizens who assisted in keeping Monticello safe.
